Lodo rituale e impugnazione per nullità del curatore

Starting from the ascertainment of the absence of a specific rule intended to regulate the appeals available against the award, the author, in the first part of the work, clarifies the scope of the art. 83 bis of the current bankruptcy law and then examines the unresolved issue of the enforceability of the award (and even before the arbitration agreement) to the bankruptcy procedure and the effects that the declaration of bankruptcy is able to produce on the arbitration proceedings still in progress. In the second part of the work, attention is focused on the effects that the bankruptcy declaration produces on the award and on the different means given to the bankruptcy trustee to appeal the award, taking into consideration that no help is provided to the interpreter by the code of the crisis and insolvency, that has very recently been issued.

Partendo dalla constatazione dell’assenza di una norma specifica destinata a regolamentare le impugnazioni esperibili dal curatore avverso il lodo, l’autrice, nella prima parte del lavoro, chiarito l’ambito di operatività dell’art. 83 bis dell’attuale legge fallimentare, prende in esame l’irrisolto tema dell’opponibilità del lodo (e prima ancora del patto arbitrale) alla procedura fallimentare, per poi analizzare gli effetti che la dichiarazione di fallimento è in grado di produrre sul procedimento arbitrale ancora in corso. Nella seconda parte del lavoro, l’attenzione viene poi concentrata sugli effetti che il fallimento produce sul lodo e ai diversi mezzi impugnatori che il curatore ha per contestarlo, tenendo in considerazione che nessun aiuto viene fornito all’interprete dal codice della crisi e dell’insolvenza appena promulgato, giacché il testo dell’art. 192 del nuovo codice ricalca in toto l’attuale art. 83 bis L. Fall.
