The contribution, inspired by the specific rules that protect the right to freedom of expression of the child contained in the UN Convention on the Rights of the child, intends to undertake a comparative analysis between these laws and the Italian legislation in force to determine whether this meets the guarantees put in place by the Convention which require the protection of the minor from the factors which may compromise significantly on his mental and physical development. The need to grant special protection to the child, by reason of the priorities that have the problems of childhood, emerges clearly from the laws adopted by the internal Legislature that, according to the United Nations Convention, they provide protection of the "best interests" of the child and therefore, demonstrate a high level of compatibility with international standards.
Il contributo, prendendo spunto dalle specifiche norme a tutela del diritto alla libertà di espressione del minore contenute nella Convenzione delle Nazioni Unite sui diritti del minore, intende procedere ad un’analisi comparativa tra tali norme e la legislazione italiana in vigore, per verificare se questa risponda alle garanzie poste in essere dalla Convenzione che impongono la tutela del minore dai fattori suscettibili di compromettere sensibilmente il suo sviluppo psico-fisico. La necessità di accordare al minore una speciale protezione, in ragione delle priorità che rivestono i problemi dell’infanzia, traspare inequivocabilmente dalle norme adottate dal Legislatore interno che, conformemente alla Convenzione delle Nazioni Unite, prevedono la tutela del “superiore interesse” del minore e, pertanto, dimostrano un elevato livello di compatibilità con le norme internazionali in materia.
