The essay provides an overview of the case law concerning the normative contents of Art. 4 of the Workers’Statute. In particular, it highlights the different opinions of legal scholars when discussing the adequacy of this provision in balancing the juxtaposed needs of employees and employers in the context of the new organisational structures of companies and ITC developments. It especially focuses on the case law concerning the so-called “defensive controls”, which has enabled a balance between the company’s right to protect its assets and receive proper performance, on the one hand, and the employees’right to freedom and dignity, on the other, thanks to the ambiguous wording of the old provision. The analysis of the new regulation — in particular a coordinated analysis of its three paragraphs — reveals some problems in adjusting the interpretation of some provisions to the legal context in which — even if amended — Article 4 is nevertheless a part. 616 Maria Teresa Salimbeni R
Il saggio fornisce una panoramica della dottrina relativa ai contenuti precettivi dell’articolo 4 dello Statuto dei lavoratori e delle diverse posizioni in merito all’adeguatezza della norma a contemperare le contrapposte esigenze dei lavoratori e dei datori di lavoro di fronte al mutato contesto organizzativo delle imprese e all’evoluzione tecnologico-informatica. Un importante passaggio riguarda la giurisprudenza sui cd “controlli difensivi” che ha consentito, complice l’ambiguità del vecchio testo, un bilanciamento tra il diritto alla tutela dei beni aziendali e dell’interesse al corretto adempimento della prestazione con i diritti di libertà e dignità dei lavoratori. L’esame del nuovo testo fa emergere alcune criticità ricavabili dalla lettura coordinata dei tre commi e dalla difficoltà di adeguare l’interpretazione di alcune previsioni con il contesto ordinamentale in cui il, sia pur novellato articolo 4, rimane inserito.
