This paper intends to present the principal issues dealt with in a recent work on the Article 5 of the Italian Constitution. The constitutional doctrine therein represented starts from attributing to the implementation process of autonomy principle a particular dynamism, and noticing that the development of the said principle has been assuming a tortuous path, mainly due to a lack of synergy of political parties and entities holding territorial autonomy. As a matter of fact, one of the most original part of the work arises from a joint interpretation of the two mentioned development processes. Finally in the book at issue have been deeply analysed and critically reviewed topics such as the complex relationship between legal science and lawmaker or between judges and legislator, in order to place legal science in front of the importance of its role.
Il contributo presenta i principali nodi teorici affrontati in un recente lavoro sull'art. 5 della Costituzione. Si tratta di una posizione incline a ravvisare nel processo di concretizzazione del principio autonomistico un particolare dinamismo, e uno sviluppo tortuoso in quegli snodi in cui si è generata una mancanza di sinergia tra i due principali motori del nuovo ordinamento repubblicano: i partiti politici e, appunto, i soggetti dell'autonomia territoriale.
