The work is focused on the new profiles of civil liability that can arise in the event of a traffic accident between two vehicles, at least one of which is (semi)autonomous. In this scenario, starting from a critical analysis of the state of the art, the work aims to achieve two objectives by applying an interdisciplinary research method. First of all, it is evaluated whether there is a civil liability regulation that is functional to protect the injured person, even in the event of damage caused by a semi-autonomous or fully autonomous vehicle. Secondly, it is verified whether this legislation is sufficient for a complete and systematic regulation of autonomous vehicles, or if it is necessary to modify the existing regulation and, eventually, to introduce an ad hoc framework of rules.
Il lavoro è incentrato sui nuovi profili di responsabilità civile derivante da incidente stradale tra due veicoli, di cui almeno uno (semi)autonomo. In questo scenario, partendo da un'analisi critica dello stato dell'arte, il lavoro mira a raggiungere due obiettivi tramite l’applicazione di un metodo di ricerca interdisciplinare. In primo luogo, viene verificata l’esistenza di una normativa sulla responsabilità civile funzionale alla tutela del danneggiato, anche in caso di danno causato da un veicolo semi-autonomo o completamente autonomo. In secondo luogo, si verifica se questa normativa sia sufficiente per una regolamentazione completa e sistematica dei veicoli autonomi, oppure se sia necessario modificare la normativa esistente o introdurre un quadro di regole ad hoc.
