The essay investigates the changes that the Next Generation EU (NGEU) programme and the National Recovery and Resilience Plan (NRRP) are operating on the system of sources of law, favouring government decree-laws over ordinary legislation. The contribution focuses, therefore, on the instrument of the decree-law to verify, with respect to the intentions of the constituents and the reconstructions of the doctrine, how this peculiar source of law is evolving today, and how it could still evolve, from a source of law limited to extraordinary cases towards a growing centrality in the system of sources of law.
Il saggio indaga i mutamenti che il programma Next Generation EU (NGEU) e il Piano Nazionale di Ripresa e Resilienza (PNRR) stanno operando sul sistema delle fonti, favorendo la decretazione d’urgenza rispetto alla legislazione ordinaria. Il contributo si focalizza, quindi, sullo strumento del decreto-legge per verificare, rispetto agli intendimenti dei costituenti e alle ricostruzioni della dottrina, come stia oggi evolvendo e come rischia ancora di evolvere questa peculiare fonte del diritto, da fonte eccezionale a fonte per eccezione.
