L’interpretazione di due testamenti olografi collegati. Un caso di studio

This work aims to highlight, through a case study, the complexity of the inter pretative process involving two interconnected holographic wills. The analysis of the testamentary records focuses on the identification of heirs and legatees and addresses issues related to disinheritance and representation, in an attempt to clarify the testator’s intent. The different possible qualifications of testamentary provisions are explored in terms of universal attribution or of institutio ex re cer ta, as well as the cumulation of the roles of heir and executor of the will. The work also examines the concurrence between testamentary succession and intestate (legitimate) succession, offering a critical analysis of the possible interpretations and of the criteria to be adopted in order to make a legally compliant choice.
