This article focuses on the function of the “constitutional tone” in conflicts of attribution. Having examined the doctrinal origins of the concept and its judicial applications over the years, among the various interpretations that have emerged, it has appeared preferable not to regard the “constitutional tone” as an autonomous admissibility requirement but, in line with the most recent case law, to link it to the requirements laid down by law and thus to the allegation, in the application, of an infringement of constitutionally guaranteed powers, by reference to clearly identifiable constitutional parameters. This interpretation, being better able than others to ensure certainty, may help to delimit the concept also in its different fields of application.
Il saggio si concentra sulla funzione del «tono costituzionale» in materia di conflitti di attribuzione. Dopo aver verificato le origini dottrinali del concetto e le sue applicazioni giurisprudenziali nel corso degli anni, tra le diverse letture emerse è apparso preferibile non configurare il «tono costituzionale» quale autonomo requisito di ammissibilità ma, in linea con la giurisprudenza più recente, ricollegarlo ai requisiti normativamente previsti e quindi all’invocazione nel ricorso della lesione di attribuzioni costituzionalmente garantite, mediante il riferimento a parametri costituzionali precisamente individuabili. Questa lettura, maggiormente in grado di restituire certezza rispetto ad altre, potrà auspicabilmente contribuire a una delimitazione del concetto anche nei suoi diversi ambiti applicativi.
